1. Introduction

These Terms and Conditions apply between you, the user of this website (including any sub-domains unless expressly excluded by their own terms), and Classy Competitions Limited (“Classy Competitions ”, “we”, “us”, “our”), the owner and operator of this website.

By accessing or using this website and/or entering any competition, you agree to be bound by these Terms and Conditions. If you do not agree, you must stop using the website immediately.

In these Terms and Conditions, “you”, “your”, “Entrant” and “User” mean any person accessing the website or entering a competition, other than any person employed or engaged by ChronoWin Limited in connection with the operation of the website or the administration of competitions.

You must be at least 18 years old to use this website or enter any competition.

References to the “Promoter” in these Terms and Conditions mean Classy Competitions Limited.

3. Nature of the Competitions

3.1 Classy Competitions operates skill-based prize competitions (“Competitions”) through this website.

3.2 To enter a Competition, entrants will usually be required to answer correctly a skill-based question, puzzle or problem (“Competition Question”).

3.3 Where a Competition features an easy question, multiple-choice question, or no Competition Question at all, a free postal entry route will be available in accordance with clause 8 below.

3.4 Competitions are intended to comply with applicable law, including the Gambling Act 2005 where relevant.

3.5 Classy Competitions is not affiliated with, endorsed by, or connected with any third-party manufacturer, brand or trade mark featured in a Competition unless expressly stated otherwise.

4. Eligibility

4.1 Competitions are open only to persons who:

  • are aged 18 or over at the time of entry; and
  • are residents of the United Kingdom.

4.2 Employees of Classy Competitions Limited, its agents, suppliers, professional advisers, or any person professionally connected with the administration of a Competition, and the immediate family or household members of such persons, are not eligible to enter.

4.3 By entering a Competition, you confirm that:

  • you are legally entitled to do so;
  • you meet the eligibility requirements in these Terms and Conditions; and
  • you are able to claim any prize you may win.

4.4 We may require proof of age, identity, residence, payment authorisation, or any other information reasonably necessary to verify your eligibility. Failure to provide this within a reasonable time may result in disqualification.

4.5 Entries from jurisdictions where participation would be unlawful are not accepted. It is your responsibility to ensure your participation is lawful.

5. Your Account

5.1 You must create an account on the website before entering any Competition, whether online or by post.

5.2 Only one account per person is permitted.

5.3 If you open or attempt to open multiple accounts, or use different identities, names, email addresses, payment methods or other details to circumvent entry limits or eligibility rules, we may:

  • close all related accounts;
  • void some or all entries;
  • refuse future participation; and
  • retain any entry fees paid.

5.4 You must provide accurate, complete and current information when creating and using your account. It is your responsibility to keep your details up to date.

5.5 We reserve the right, at our sole discretion and without giving reasons, to:

  • refuse to open an account;
  • suspend or close an account;
  • refuse an entry;
  • disqualify any entrant; or
  • void an entry or entries.

6. How to Enter Online

6.1 Each Competition will display on the website:

  • the opening date;
  • the closing date and time;
  • the price per entry, if applicable;
  • the number of entries available;
  • any entry cap per person;
  • the Competition Question, if applicable; and
  • the prize description.

6.2 To enter online, you must:

  • log in to your account;
  • select the Competition you wish to enter;
  • select the number of entries;
  • answer the Competition Question where applicable;
  • provide or confirm your contact and billing details;
  • complete payment; and
  • submit your entry before the closing date and time.

6.3 If your answer to the Competition Question is correct, your entry will be included in the draw.

6.4 If your answer is incorrect:

  • you may still be charged;
  • your entry will not be included in the draw.

6.5 When purchasing multiple entries in a single order, the answer submitted with that order may apply to all entries in that order.

6.6 You must enter using your full legal name. Entries submitted using initials, false names, incomplete names or other inaccurate details may be declared invalid and may still be charged.

6.7 All entries must be submitted in English.

6.8 We will usually send an email confirming receipt of an online entry, but we are not responsible if such email is not received for technical or other reasons.

7. Entry Limits and Restrictions

7.1 Some Competitions may include a maximum number of entries per person. Where applicable, this will be stated on the Competition page.

7.2 If you attempt to exceed the entry cap, we may:

  • block the purchase;
  • void excess entries;
  • disqualify the excess entries from the draw; and/or
  • retain the charges relating to those entries.

7.3 Free entries awarded through any promotion or early-bird mechanic may, where expressly stated by us, be excluded from entry cap calculations.

7.4 Bulk entries, automated entries, script-generated entries and any other form of artificially generated entry are prohibited.

8. Free Postal Entry Route

8.1 Where a free entry route is required or offered, you may enter by post.

8.2 Postal entries are only valid if all of the following conditions are met:

  • you must first create an account on the website;
  • your entry must be sent by handwritten postcard only;
  • your entry must be sent by first or second class post;
  • hand-delivered entries will not be accepted;
  • special delivery or courier delivery will not be accepted;
  • each postal entry must be sent separately; bulk entries in one envelope or package will count as one entry only or may be rejected entirely;
  • the details on your postcard must exactly match the details on your website account.

8.3 Your postal entry must be sent to:

8.4 Your postal entry must include:

  • the name or details of the Competition you wish to enter;
  • your full name;
  • your full postal address;
  • your email address;
  • your telephone number;
  • your answer to the Competition Question, where applicable; and
  • a statement confirming that you accept these Terms and Conditions.

8.5 Incomplete, illegible, damaged, unclear or non-compliant entries will be disqualified.

8.6 Postal entries must be received by us before the stated closing date and time. Proof of posting is not proof of delivery or proof of entry.

8.7 If a Competition has sold out, reached an entry cap, or closed before your postal entry is received and processed, your postal entry will not be entered into that draw.

8.8 We are under no obligation to acknowledge receipt of any postal entry, confirm whether it has been received, or confirm whether the answer is correct.

8.9 For shortened competitions, flash draws, weekend draws or similar rapid-turnaround Competitions, postal entries will only be included if they are physically received and processed by us before the draw and before the Competition has sold out or closed. By entering such Competitions by post, you accept the greater risk that your entry may arrive too late to be included.

9. Payments

9.1 Entry fees, where applicable, are payable at the price shown on the website at the time of entry.

9.2 Your entry is not valid until payment has been successfully authorised and processed.

9.3 If a payment fails, is declined, is reversed, is charged back, or is later found to be unauthorised, the related entry or entries will be void.

9.4 We reserve the right to refuse any transaction or payment method at our discretion.

9.5 Any multi-buy discounts or promotional pricing apply only at the time of purchase and will not be applied retrospectively.

10. No Refund Policy

10.1 Except as set out in these Terms and Conditions, all entries are final and non-refundable.

10.2 No refunds will be given for:

  • incorrect answers;
  • duplicate or excess entries;
  • ineligible entries;
  • disqualified entries;
  • late entries;
  • failed or delayed postal delivery;
  • account suspension or closure resulting from your breach of these Terms.

10.3 Refunds will only be given where:

  • we cancel a Competition; or
  • we are otherwise required to do so by law.

10.4 By entering a Competition, you acknowledge that the purchase is for a leisure service with a specific closing date, and that any statutory cooling-off rights may not apply to the extent permitted by law.

11. Competition Periods

11.1 Each Competition will run from the opening date until the earlier of:

  • the stated closing date and time; or
  • the point at which all available entries are allocated or sold.

11.2 All times and dates referred to on the website are London time.

11.3 We reserve the right to amend the opening date or closing date where reasonably necessary, provided we do not extend a Competition simply to sell more entries.

11.4 We may close a Competition early if all available entries are allocated or sold.

11.5 We reserve the right to cancel, void, suspend or amend a Competition where it becomes necessary to do so, including for operational, legal, regulatory, fraud-prevention or technical reasons.

11.6 If we cancel or void a Competition, affected entrants will receive a refund of the entry fees paid for that Competition within a reasonable time.

12. Draw Process

12.1 After a Competition closes, all eligible entrants who correctly answered the Competition Question, or all eligible entrants where no Competition Question applies, will be entered into the draw.

12.2 The winner will be selected using a verified random number generator.

12.3 The draw will be live streamed on Instagram.

12.4 We may publish or display an entry list prior to the draw. Entry numbers or allocations may be adjusted before publication of the final entry list where necessary to correct administrative or technical issues.

12.5 The draw will take place as soon as reasonably practicable after the Competition closes, and usually within 7 days unless otherwise stated.

12.6 Our decision in relation to the draw, the winning entry and the validity of entries is final.

13. Winner Selection and Contact

13.1 We will attempt to contact the winner using the email address and/or telephone number associated with the winner’s account.

13.2 We will usually attempt contact within 48 hours of the draw.

13.3 It is your responsibility to ensure your contact details are correct and kept up to date.

13.4 We will not be responsible if we are unable to contact a winner because the account details provided are incorrect, incomplete or out of date.

13.5 If a winner:

  • cannot be contacted;
  • does not respond;
  • does not accept the prize;
  • fails verification;
  • is disqualified; or
  • otherwise fails to comply with these Terms and Conditions,

we may declare the prize forfeited and either:

  • select another eligible winner; or
  • retain the prize for a future Competition.

13.6 A winner must respond and complete any verification within 7 days of the first contact attempt. We may extend that period at our discretion.

14. Verification of Winners

14.1 Before any prize is awarded, the winner may be required to provide:

  • proof of identity;
  • proof of age;
  • proof of address;
  • proof of ownership or authorised use of the payment method used;
  • any other documents reasonably requested by us.

14.2 Acceptable proof of identity may include a valid passport or driving licence. We may request additional documentation where necessary.

14.3 Failure to provide satisfactory verification within the required time may result in disqualification and forfeiture of the prize.

15. Prizes

15.1 The prize for each Competition will be described on the website.

15.2 All prize descriptions, market values, specifications and condition statements are provided in good faith but are approximate only.

15.3 We make no representation or warranty that:

  • any valuation is accurate;
  • any market value will be achieved on resale;
  • any prize is fit for any particular purpose; or
  • any prize description is complete, current or error-free.

15.4 Prizes are:

  • non-transferable;
  • non-negotiable; and
  • not exchangeable.

15.5 No cash alternative will be offered.

15.6 We reserve the right to substitute a prize with a prize of equal or greater value if the original prize becomes unavailable for reasons beyond our reasonable control.

15.7 Where relevant, any manufacturer warranty or third-party warranty may transfer to the winner if transferable, but we do not provide any additional warranty unless expressly stated.

16. Prize Delivery and Collection

16.1 Prize delivery or collection arrangements will be made after the winner has been verified.

16.2 We may deliver the prize:

  • by hand;
  • by tracked and insured courier; or
  • by making it available for collection.

16.3 Unless otherwise stated, one delivery attempt to a mainland United Kingdom address may be included.

16.4 A winner, or a representative approved by us in writing and carrying photo identification, must be available to receive and sign for the prize where required.

16.5 We may charge additional delivery, redelivery, storage, insurance or administration costs where:

  • the winner changes the delivery address;
  • delivery fails due to the winner’s fault;
  • the destination is outside mainland United Kingdom; or
  • special arrangements are requested.

16.6 If the winner requests export or delivery outside the United Kingdom, we may refuse and instead require collection from us where appropriate.

16.7 Risk in the prize passes to the winner on delivery or collection. Title passes when we have completed the transfer to the winner.

16.8 Once the prize has been delivered or collected, we accept no further responsibility for it.

17. Publicity and Winner Information

17.1 We may publish or make available information indicating that a valid award has taken place. This may include the winner’s first name, surname initial, town, county or similar limited identifying information.

17.2 By entering a Competition, you agree that if you win, we may use your name, town or county, likeness, photographs, videos and statements for reasonable promotional and publicity purposes connected with the Competition and future Competitions, unless prohibited by law.

17.3 If you object to some or all of your winner information being published or made public, you must notify us before the closing date. In such a case, we may still disclose relevant information to regulators, the Advertising Standards Authority, law enforcement, payment providers, or other authorities where legally required.

17.4 We may request that winners participate in reasonable publicity. If you refuse, we reserve the right to limit public promotional use to the minimum required to demonstrate that a genuine prize award took place.

18. Fraud, Abuse and Prohibited Conduct

18.1 We reserve the right to disqualify any entrant, void any entry, suspend or close any account, and refuse future participation where we reasonably suspect:

  • fraud or attempted fraud;
  • false identity or impersonation;
  • payment fraud or chargeback abuse;
  • use of multiple accounts;
  • automated or script-generated entries;
  • manipulation of entry caps or ticket limits;
  • hacking, attempted hacking, or interference with the website or draw systems;
  • abusive, threatening or harassing behaviour towards staff, contractors or other entrants;
  • any conduct contrary to the spirit or intention of the Competition.

18.2 Where fraud or abuse is suspected, no refund will be due.

18.3 We may share relevant information with payment processors, fraud-prevention agencies, law enforcement and regulatory bodies where appropriate.

19. Website Use and Intellectual Property

19.1 All content on the website, including text, images, graphics, logos, video, design, software and underlying code, is owned by or licensed to Classy Competitions and is protected by intellectual property laws.

19.2 You may access and use the website for your own personal, non-commercial use only.

19.3 You must not:

  • copy, reproduce, republish, distribute or exploit website content for commercial purposes;
  • interfere with the operation or security of the website;
  • upload malicious code;
  • attempt unauthorised access to any part of the website or associated systems.

19.4 Nothing on the website grants any licence or right to use any trade mark, brand, logo or content without prior written permission.

20. Availability of Website and Services

20.1 The website and all associated services are provided on an “as is” and “as available” basis.

20.2 We do not guarantee that the website will be uninterrupted, secure, error-free or free from viruses or malicious code.

20.3 We may alter, suspend or discontinue any aspect of the website or any Competition at any time.

20.4 We are not responsible for entries not received, delayed, corrupted or lost due to technical issues, traffic, connectivity problems, postal delays or any other matters outside our reasonable control.

21. Limitation of Liability

21.1 Nothing in these Terms and Conditions limits or excludes liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation; or
  • any other liability which cannot lawfully be excluded.

21.2 Subject to clause 21.1, to the fullest extent permitted by law, Classy Competitions shall not be liable for:

  • loss of profits, revenue, business, goodwill or opportunity;
  • indirect or consequential loss;
  • loss arising from delayed, incomplete, invalid or disqualified entries;
  • loss arising from technical failures, payment failures, postal failures or website downtime;
  • inaccuracies in prize descriptions, market values or third-party information;
  • any loss arising after delivery or collection of a prize.

21.3 Your statutory rights are not affected.

22. Data Protection and Privacy

22.1 Any personal data supplied by you, or obtained lawfully from third parties, will be processed by us for the purposes of:

  • administering your account;
  • administering Competitions and draws;
  • verifying eligibility and identity;
  • delivering prizes;
  • fraud prevention and legal compliance;
  • marketing where permitted by law or where you have consented.

22.2 Your personal data will be processed in accordance with our Privacy Policy.

22.3 We may disclose your data where reasonably necessary to:

  • payment processors;
  • fraud prevention agencies;
  • couriers and delivery providers;
  • professional advisers;
  • regulators, law enforcement or courts;
  • any purchaser or successor in connection with a business sale or restructure.

22.4 Where necessary, your personal data may be processed outside the United Kingdom, in which case we will take reasonable steps to ensure appropriate protection is in place.

22.5 If you ask us to delete or stop processing data necessary for the administration of a live Competition you have entered, you may be treated as withdrawing from that Competition and may forfeit your entry without refund.

23. Social Media

23.1 Competitions may be promoted through social media platforms, including Instagram and Facebook.

23.2 Unless expressly stated otherwise, Competitions are not sponsored, endorsed, administered by, or associated with Instagram, Facebook or any other social media platform.

23.3 By entering, you agree that those platforms bear no responsibility or liability in connection with any Competition.

24. General

24.1 We may amend these Terms and Conditions from time to time. The latest version will always be available on the website.

24.2 Any amendment will take effect from publication, but we will not materially alter the terms applying to a live Competition in a way that unfairly affects entrants already entered.

24.3 If any provision of these Terms and Conditions is found invalid, illegal or unenforceable, the remainder shall continue in full force and effect.

24.4 These Terms and Conditions, together with our Privacy Policy and any Competition-specific terms displayed on the website, constitute the entire agreement between you and us in relation to Competitions.

24.5 No delay or failure by us to enforce any right shall constitute a waiver of that right.

24.6 You may not assign or transfer your rights under these Terms and Conditions.

24.7 We may assign or transfer our rights and obligations under these Terms and Conditions provided that doing so does not adversely affect your rights.

24.8 The Contracts (Rights of Third Parties) Act 1999 shall not apply and no third party shall have any right to enforce any term of these Terms and Conditions.

25. Governing Law and Jurisdiction

These Terms and Conditions, all Competitions, and any dispute or claim arising out of or in connection with them, whether contractual or non-contractual, shall be governed by the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction.
